Terms & Conditions

PLEASE READ THESE TERMS CAREFULLY. BY ACCESSING OR PARTICIPATING IN THE ASCEND AREA CUSTOMER LOYALTY PROGRAM (“PROGRAM”), YOU AGREE TO BE BOUND BY THESE TERMS AND CONDITIONS (“TERMS”), INCLUDING ANY FUTURE MODIFICATIONS WE MAY MAKE. IF YOU DO NOT AGREE TO THESE TERMS, YOU MAY NOT PARTICIPATE IN THE PROGRAM.

INTRODUCTION

The Ascend Area Market’s Customer Loyalty Program (“the Program”) is a promotional platform developed by Ascend Area Market (“Ascend Area”,” “we,” “our,” or “us”) to incentivize and reward guests for consistent engagement with our health-forward retail and dining offerings. This Program is managed through Toast’s point-of-sale (POS) system and digital ordering platform.

The Program is subject to all applicable laws and is void where prohibited.

PROGRAM ELIGIBILITY

To enroll and participate in the Program, you must:

  • Be a natural person (i.e., not a corporation or entity);

  • Be at least 16 years of age or the age of majority in your jurisdiction;

  • Maintain a valid email address or phone number;

  • Agree to these Terms and our Privacy Policy.

We reserve the right to verify your eligibility and to refuse or terminate your participation without prior notice if you are found to be in violation of any part of these Terms.

ENROLLMENT & ACCOUNT CREATION

How to Enroll

You may join the Program through the following channels:

  • Kiosks at any participating Ascend Area Market location;
  • Toast-powered online ordering platform.

No purchase is required to join. Upon registration, you will receive a loyalty profile where points, tier status, and rewards will be tracked.

Account Integrity

You may only maintain one active loyalty account. Any attempt to create or use multiple accounts may result in deactivation, cancellation of rewards, and forfeiture of tier status.

POINT ACCUMULATION & REWARDS

Earning Points

You will earn points based on eligible pre-tax spend:

  • 1 point per $1 spent (excluding tax, tip, gift cards, and service fees).
  • Points are awarded only for completed and paid transactions.

Bonus Point Opportunities

  • Sign-Up Bonus: 25 points for new enrollments.
  • Birthday Bonus: $5 off coupon issued in your birth month.
  • Dining Method Bonus: 2x points on takeout orders via Toast’s online platform.
  • Day-of-Week Bonus: 2x points for all orders on Tuesdays.

 

Bonus point values, eligible days, and transaction windows may change without notice

Point Validation

  • Points may take up to 48 hours to appear in your account.

  • All points are subject to audit and may be adjusted for returns, fraud, or system errors.

REWARD REDEMPTION

Redemption Channels

You may redeem points through:

  • Self-service kiosks at participating locations;

  • Toast digital ordering checkout process.

Redemption Values

  • 100 points = $5 reward.

  • Rewards are redeemable only in full increments and cannot be applied to taxes, gratuity, or gift card purchases.

Rewards have no cash value, are non-transferable, and cannot be exchanged for cash unless required by law.

Expiration of Rewards

  • Issued rewards must be redeemed within 7 days.

  • After expiration, a new earning cycle begins.

  • Expired rewards will not be reissued or extended.

Tier Cycle & Conditions

  • Tiers reset monthly. Guests must maintain the spend threshold every month to retain their tier.

  • Benefits must be claimed within 30 days of achieving the tier or will expire.

Guests are not entitled to lower-tier benefits if they fail to maintain their current level.

Additional Incentives

  • Top spenders and referrers may be eligible for special giveaways or limited-edition perks.

  • All freebies and bonus items are at the sole discretion of Ascend Area and subject to availability.

PROGRAM LIMITATIONS AND FRAUD POLICY

Prohibited Conduct

The following actions are strictly prohibited:

  • Creating multiple accounts;

  • Misrepresenting purchases;

  • Using third-party bots, automation tools, or fraudulent transactions;

  • Redeeming rewards without a qualifying purchase.

Violations & Penalties

If fraudulent activity is detected:

  • Your account may be suspended or terminated.

  • All points, tiers, and rewards may be forfeited without notice.

  • You may be banned from future participation in the Program.

 

Guests who believe their account was suspended in error may contact us within 30 days of receiving notice for a formal review.

PRIVACY & DATA COLLECTION

We collect and process your personal data to administer this Program. This includes:

  • Purchase history

  • Contact information

  • Redemption and tier status

This information is managed through Toast’s platform and is subject to both Toast’s and Ascend Area Market’s. Privacy Policies – https://pos.toasttab.com/privacy 

You consent to receive Program-related communications via SMS, email, or in-app notifications. You may opt out of marketing emails at any time, but transactional notifications are required for Program participation.

MODIFICATION & TERMINATION OF PROGRAM

Ascend Area Market reserves the right to:

  • Modify these Terms;

  • Change or eliminate the Program;

  • Alter the point structure, tier thresholds, or reward system.

Material changes will be communicated via email or store signage at least 30 days prior to taking effect.

Your continued use of the Program after such notice constitutes your acceptance of the updated Terms.

DISCLAIMER OF WARRANTIES

THE PROGRAM IS PROVIDED “AS IS” AND “AS AVAILABLE.” ASCEND AREA MARKET DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not guarantee:

  • Continuous access to the Program;

  • Availability of rewards at all times;

  • Accuracy or reliability of points calculations.

LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY LAW, ASCEND AREA SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR PARTICIPATION IN THE PROGRAM. OUR TOTAL LIABILITY TO YOU SHALL NOT EXCEED $100.

GOVERNING LAW AND DISPUTE RESOLUTION

The laws of the Country, excluding its conflicts of law rules, shall govern this Terms and Your use of the Service.

All disputes must first be resolved through good faith negotiations. If unresolved, disputes shall be submitted to binding arbitration in the United States, in accordance with the rules of the American Arbitration Association. You agree to waive any right to a jury trial or class action.

MISCELLANEOUS LEGAL TERMS

Severability

 If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision will be limited or eliminated to the minimum extent necessary so that the remaining provisions remain in full force and effect.

Waiver

Our failure to enforce any right or provision in these Terms does not constitute a waiver of that right or provision.

ENTIRE AGREEMENT

These Terms represent the entire agreement between you and Ascend Area Market regarding the Program and supersede all prior or contemporaneous communications. If any provision is deemed invalid or unenforceable, the remaining provisions shall remain in full force and effect.
